This wouldn't make any difference because Electronic Arts aka EA owns Maxis.

When I last time looked SimAnt package, it said (c) Maxis. I don't know is it a new EU directive that the developers have rights 'cause previous time it was (c) Electronic Arts. Strange...

One problem when contacting these companies, especially giants like EA, is that you've not got much chance of actually getting in touch with someone who could authorise it. Could be that the legal bods at EA couldn't care less whether you distributed an ancient game, but your email isn't likely to get any further than some customer service rep or admin assistant.
